REACH stands for Registration, Evaluation, Authorisation and Restriction of Chemicals. It entered into force on 1 June 2007.
REACH is European Union's regulation which has been accepted for the betterment of protection of human health as well as environment from the hazards of chemicals along with boosting the competitiveness of EU chemicals industry. This also provides and markets a secondary method for rick assessment of substances so that number of animal tests can be reduced.
REACH is applicable to every chemical substance used in industrial processes as well as daily used ones by people such as paints, cleaning products, and also in furniture, clothes and electrical appliances. In line with this, the regulation affects almost all the companies in EU.
REACH is responsible for keeping the burden proof on the companies. It is important to comply with regulations and for this companies will have to identify as well as manage to hazards related to their products manufactured as well as marketed in the EU. The companies have to demonstrate to ECHA on the safe use of their products and its management measures should be conveyed it to the users.
All chemical substances produced or imported in the European Economic Area between 1 and 100 tons a year need to be registered by 31 May 2018 with the European Chemicals Agency (ECHA). This is the last deadline for existing chemicals under the REACH Regulation.
How does REACH work?
REACH has the responsibility to create processes to collect and then asses the data on features and hazards of products. Companies will have to register their products. ECHA acquires and then assess individual registrations to ensure its compliance. After this, the EU Member States assessed choose substances for clearing initial concerns for human health or environment. The scientific committees of ECHA and the authorities are together responsible for checking the management of risks of the products.
REACH's effect on Companies
Under REACH, one might have any of the following roles:
Manufacturer: As a chemical manufacturer, then you will have extra duties under REACH.
Importer: When importing from outside the EU/EEA, you might have more duties under REACH. The products can be clothes, plastic goods, furniture, separate chemicals and mixtures.
Downstream Users: During manufacturing of non-chemical products, companies might use some chemical without their knowledge. Hence, you need to double check your obligations.
Companies that are established outside the EU are not bounded via the obligations of REACH.
